The Patchwork of Laws and Enforcement

In 2021, the Texas Department of State Health Services (DSHS) moved to classify Delta-8 THC as a controlled substance. However, this action was challenged in court, and a temporary injunction has allowed retailers to continue selling Delta-8 products—for now.

Texans seeking therapeutic benefits from cannabis derivatives—such as those managing chronic pain, PTSD, or epilepsy—are left to navigate an unregulated market or attempt to qualify for the narrow Compassionate Use Program.

Looking Forward

As public sentiment shifts and demand grows, the state legislature may eventually revisit and refine its position on hemp-derived cannabinoids. Until then, consumers should remain informed, cautious, and proactive about product sourcing.

For now, hemp-derived THC remains accessible—but it’s wise to keep one eye on the legal horizon.
